This government was accepting of racism from its inception. Not only was the Senate a creation to allow the lesser populated southern states an unequal voice in the passage of legislation, the apportionment of representatives to the House by population was skewed by the inclusion, in the Census, of human chattel, a legal term that to this day encompasses cows and horses giving a man ownership rights under the law, as equal to three fifths of a freeman; thereby, giving Thomas Jefferson with 300 slaves the equality of 181 citizens of a free state. These concessions were proffered, as was the Bill of Rights insisted upon by the South Carolina delegation, to induce the passage of a governing document that allowed for a centralized, and primary power of taxation to the federal government. The reality, that African-Americans are indeed humans, was left for the bloodied fields of the Civil War to decide. It is still problematic today because some equate treason, which is what secession was, with liberty. Freedom is allowing all people to think as they wish. In this country no person can be held as a criminal for what they believe. Liberty is a term that encompasses action. If one were to take ones belief and attempt, either through voice or action, by way of ones personal or collective belief, to limit the legal action, or quiet enjoyment of life, upon another, thereby encroaching upon others legal acts, that person is beyond the protection a just interpretation of his liberty should provide, and should be therefore restrained. Whether this restraint is by law or societal exile such a person must be retained in order for a free society to flourish. Every man is equal under the law, supposedly. Was Michael Brown?
