I HAVE A GRIEVANCE AGAINST
The Project Gutenberg Literary Archive Foundation, PMB 113, 1739 University Avenue, Oxford, MS 38655 [USA].

I am an author, penning poetry, both in English and my mother tongue, Malayalam. I am also translator of Malayalam scriptures into versified English. Few books were released. I am linked, to face book and twitter, for some time.

One of my books “Truth and the Myth”, published in 2000, contains couplets quips, in English which was well accepted in the US, Indian and European Book markets from the day it was released.

I wished, if someone established in the US Books trade takes over its marketing in US, soon I could become a “Non-English Speaking English poet”. Among many I corresponded with, Mr. Michael Hart, Head of Department of Library, Illinois University, who has several years of trade experience, came forward to take it up. He has just started an ambitious project of Gutenberg Literary Foundation under the University dealing in 10,000 national and international books for the university with an ambition of spreading its activities to the whole world, galloping at high speed reach the 50,000th milestone within a year.

We agreed that he would confine his marketing to my e-books only and he shall pay me a royalty of not less than $ 4.00 on each e-Book sold by him or the University. It was also agreed that Mr. Hart shall thwart any effort on the public to pirate it.

Mr. Hart voluntarily promised the above royalty, without even a discussion on it, and guaranteed that my share @ the above rate due to me would be determined for the previous month at the beginning of every month, collected and paid, along with each and every supply.

BEGINNING - a bumpy ride

Accordingly, some papers, purported to have been the agreement, without anyone signing or a signer named, were sent to me. However, instead of signature, it carried the following lines, where normally the signature is affixed. When I sought signed contracts, I was told “computer generated documents need no signature or any other authorisation by countersigning. What you have now is valid”.

Gutenberg had declared in the agreement that:
“A.R. Narayanan, of Cochin, India has donated this etext for redistribution by Project www.Gramotey.com. He would welcome your comments, as well as any payment for this etext. He may be contacted by email to: arswati@md4.vsnl.net.in”

It further agreed that: Project www.Gramotey.com.

“Michael Hart (trademark owner) and the etext's copyright owner
(2) Pay a royalty to the Project of 20% of the gross
(1) Honor the refund and replacement provisions of this
"Small Print!" statement; and
(2) Pay a royalty to the Project of 20% of the gross
profits you derive calculated using the method you already use
to calculate your applicable taxes. If you don't derive
profits, no royalty is due”

“Book buyers’ comment: as well as any payment” for this etext.: the words “this etext” expressly refers to their occult part of contractual obligation to A.R. Narayanan and admits their liability to pay him immediately. {page 2 of Gutenberg}

He volunteered information about : "We produce about two million dollars for each hour we work. The time it takes us, a rather conservative estimate, is fifty hours to get any etext selected, entered, proofread, edited, copyright searched and analyzed, the copyright letters written, etc. This projected audience is one hundred million readers. If our value per text is nominally estimated at one dollar then we produce $ 2 million dollars per hour this year as we release fifty new Etext files per month, or 500 more Etexts in 2000 for a total of 3000+ If they reach just 1-2% of the world's population then the total should reach over 300 billion Etexts given away by year's end." (`Agreement Page .) This is highly confusing.

I.R.S. granted Gutenberg the status of Charity Organization and tax exemption with. consequential rights and responsibilities imposed on it by “Publication 557” Section 501(c)(3) of the Internal Revenue Code treating as Public” on Tax ec\xempt status, computing Donations taking in sales proceeds, sales tax and other taxes along with lump sum charities.

I.R.S. has exempted Gutenberg only from paying tax on to the extent of sales component to cheapen the total purchase value of merchandize. In such cases, organization exempt from federal income tax under Section 501(c)(3) of the code, cannot exempt the commodity the buyer bought paying the capital cost of the commodity and incur loss on Billion/Trillion $, you have calculated as income.

Copyright was granted for sale of eBook, i.e., computer soft copy from which any number of copies could be generated. The Gutenberg infringed copyright agreement by doing the following:

 The text 1 supplied was meant for Free distribution as eBook which was sold for cash, showing sales realization denominated as ‘Donation’.
 Sold my text as etexts and books, world over, beyond the territory copyrighted for sales.
 Edited the text of my book, without my permission. It is a serious offense of infringement.
 They have declared the ("Project") under the "Project Gutenberg" trademark assumed with the permission of Mr. Michael Hart (trademark owner) and the etext's copyright owner. (Agreement Page 2.)
 Sold Copyright of my book for other parts of the globe as if Gutenberg is the sole owner of copyright of this book.
 Gutenberg further instructs their clan that: “Our e-Books are free in the United States because its copyright has expired”. It is wrong. First of all there is no provision in the Copyright Act. Secondly, it remains copyright asset mine or my heirs until 60 years of my death.
 Assigned copyrights to many others and organizations without informing me.
 In India, Gutenberg is marketing our product qualifying it as “Traditional Verses”. It is intended to misguide all of us.

For this book, of course, I preferred to compose it in verse which never touches American or Indian Traditional verses or folk songs. All that are my own thoughts and imageries, each composed, to fill two lines.

 Manuscript was completed during 1997-98 and published the paperback edition in 1998. Mr. Hart was attracted by the comments made in the book around social background of India strewn in every word of it.

I am seventy-five years old, retired, spending twilight years without any revenue. I am victim of cardiac ailment, diabetes and, Parkinson’s disease which, with all their destructive might, are killing me financially as well. I have to go for a Deep Brain Stimulation (DBS) Surgery as cure for the hellish Parkinsonism at a cost of one million Indian Rupees at the earliest possible.

Average finances of an Indian, are very much unimaginably meagre and spending for such costly treatment could be availed of only by few affluent business persons. It is very much pathetic and paradoxical that a vibrant (I used this word here to impress upon you as to how much effortful I need work for earning a middle-class living while the Parkinsons disease’s infamous, painful physical tremor, also is vibrant while it is painful.)

The dispute could be resolved only within your country and by your questioning of few of your people, for the whole incident took place in the US. My contenders being far off, on the other side of the globe, I beseech your intervention into the matter to bring out a settlement and help me undergo surgical correction that would save me from the deadly disease.

I am referring to your mail of the 31st December 2013. I am sorry, your contentions are not convincing, mainly because:
(Quotes from your letter are typed red)

You have admitted, in this mail of 31 Dec. 2013, in unequivocal terms, that: “We are aware that some illegal reselling of Project Gutenberg content happens.” Since we are, geographically long way apart, you were entrusted with my “special client’s chair” providing free e-book and care; you should have taken immediate action to nip such criminal onslaughts in the bud but did nothing to curb it.

2.
You asserted in the same mail that “Unfortunately you are mistaken in the fundamentals: Project Gutenberg does not sell anything, and does profit from any sales that occur from our public domain content”. Going by your own data, anyone could make out that you have sold millions of copies of my book, Truth and the Myth, as paperbacks all over the world.

3.
You claim, you used to remind every purchaser, to collect comparatively higher funds: “We need your donations more than ever!” and were collecting paltry sums, a dollar or fifty cents, from each buyer as donation will be unwieldy to keep accounts for and hence take lump sum payments as donation from dealers.

4.
Mr. Hart confirms, he had sworn upon God and instructed his office that $ 4.00 has to be paid to Mr. A.R. Narayanan from every bill raised for Narayanan’s eBook marketed by Gutenberg.
This is the fourteenth year, after I made the contract. I expected Gutenberg to get in touch with me anytime during this period. Nay, none showed the courtesy of calling me at least once and talk it over.

5.
You have only one source of income, donations, from the buyers who, in turn, are dependent on their income from sales. What you get from the dealers certainly are, logically, funds to be accounted as “sales proceeds” which you call by pet name “Donation” probably in an effort to show minimal funds inflow.

Mr. Hart and me agreed that I shall not sell and or you, in turn, it to any other body, individually in US and he, in turn, shall pay me a royalty of not less than $ 4.00 on each e-book sold by them or University, in any country from their end.

Mr. Hart voluntarily promised the above royalty, without dispute, @ the above rate, the due to me would be determined every month, collected and paid to you along with each and every supply, on the spot.

I once again request you to let me know the account of the money due to me as royalty against the book ‘Truth and the Myth’ and how you would be effecting the same.

What matters is doing sincere and straight forward business without hurting the life and finance of small entrepreneurs and authors and poets, living hand to mouth life. They are to be classified as venerated asset to the nation. I strongly believe the aggrieved poet is right and his right should be granted. I agree with him.
